Disadvantages of Dying Without a Will 

  • Undesired Results- Your assets are going to pass as the law is currently situated at the time of your death, which may not be how you desire. 
  • Costs and Delays- Following your death, probating your estate without a will can take more time and money and cause more stress for your loved ones.
  • Certain loved ones may not be accounted for- step-children, unadopted children and illegitimate children are examples of persons under the law who may not inherit from a decedent's estate when there is no will. There are some exceptions such as adoption by estoppel, however this is a difficult option and isnot a guaranteed result.
